1. Legal information and agreement

These provisions regulate the use of the Internet portal service (hereinafter, the ‘Portal’) that IRENE BOZZA (hereinafter, IRENE BOZZA) makes available to Internet users.

The condition of user of the portal is established by the sole access to the Portal by the user (hereinafter, the ‘User’) and implies the acceptance of all conditions included in this LEGAL NOTICE/CONDITIONS OF PURCHASE.
Therefore, it is advised that the user reads this LEGAL NOTICE/CONDITIONS OF PURCHASE before making a purchase.
The User must read this Legal Notice carefully in any and all occasions in which intends to use the Portal, as both the Portal and its Terms of Use, included in this Legal Notice, may be subject to changes.
Some Portal services accessible to Internet users or exclusive to IRENE BOZZA’s clients may be subject to specific conditions, regulations and instructions that, where appropriate, may replace, extend, and/or modify this Legal Notice, which must be accepted by the User before initiating a purchase.

2. Intellectual and industrial property

All contents of the Portal, which may include the designs of the products (in this case, jewellery), text, photographs, graphics, images, icons, technology, software, links and other audio-visual or sound content, as well as its graphic design and source code (hereinafter, the ‘Content’), are the intellectual property of IRENE BOZZA or third parties. The aforementioned list is provided as an example and is not exhaustive. By providing access to the Content, IRENE BOZZA does not in any way transfer to the User any exploitation rights, as recognized by current legislation on intellectual property, with the except of those rights that are strictly necessary for the use of the Portal.

The trademarks, brand names or distinctive logos are the property of IRENE BOZZA or third parties. Access to the Portal does not constitute a transfer of any rights of the aforementioned trademarks, brand names and/or distinctive logos.

3. Conditions of Use of the Portal

3.1 General

The User undertakes to make proper use of the Portal in accordance with applicable laws and the terms of this Legal Notice. The User will be liable to IRENE BOZZA or to any third parties for any damages that may result from the breach this obligation.

It is expressly forbidden to use the Portal for purposes that would be harmful to the property or interests of IRENE BOZZA or any third parties, or that in any other way may overload, damage or disable the networks, servers and other computer equipment (hardware) or computer products and applications (software) of IRENE BOZZA or third parties.

3.2 Content

The User commits to use the Content in accordance to applicable laws and this Legal Notice, as well as with all other conditions, regulations and instructions that may be applicable in conformity with the provisions of this clause.

The User, in accordance with current legislation, must refrain from: reproducing, copying, distributing, making available to others, communicating publicly, transforming or modifying the Content, except in cases authorized by law or expressly consented for their use.
The user must refrain from reproducing or making copies for private use of any Content that may be considered Software or Databases, in accordance with current intellectual property legislation, as well as transmitting it publicly or making it available to third parties when these acts necessarily imply reproduction of the Content by the User or a third party.
The user must refrain from extracting and/or reusing the whole or a substantial part of the Content of the Portal, as well as the databases that IRENE BOZZA makes available to Users.

3.3 Data collection forms

Notwithstanding the foregoing provisions of this Legal Notice, as well as the privacy policies accessible at Portal and which might be applicable at any time, the use of specific services or requests addressed to IRENE BOZZA are contingent on the previous completion of the corresponding User registration. All the information provided by the User through the Portal forms for the above purposes, or any other, must be true. For these purposes, the User guarantees the authenticity of all the data entered in forms and commits to keep all information provided to IRENE BOZZA perfectly updated so that it reflects, at all times, the actual situation of the User. In any case, the User will be solely responsible for any false or inaccurate statements entered in the forms, as well as for any damages caused to IRENE BOZZA or third parties due to the information provided.

3.4 Incoming links to the Portal

Any Internet user who wishes to create links from their own web pages to the Portal must comply with the conditions detailed below. In any case, the User accepts that the lack of knowledge does not exempt the User from legal responsibilities:

Incoming links to the Portal will only link to the home page or main page of the Portal, but cannot reproduce Content of the portal in any way or format (online links, text, graphics, etc.)

In any and all cases, and in compliance with applicable legislation in effect at any time, it is strictly prohibited to insert pages of the Portal in any “frames” in other websites, or any other kind of technology that might allow to provide visualization of the Content of the Portal through Internet addresses other than those of the Portal and, in any case, to be displayed alongside with contents outside the Portal in such a way that: (I) it produces or might produce error, confusion or deceit in the users about the true origin of the service or Content; (II) constitutes an act of unfair comparison or imitation; (III) serves to take advantage of the reputation of the IRENE BOZZA brand and prestige; or (IV) in any other way that is prohibited by current legislation.

No false, inaccurate or incorrect statements about IRENE BOZZA, its partners, employees, customers or the quality of the services provided shall be made from any page that includes links to the Portal.

It is strictly forbidden to include statements on an external page that includes a link to the Portal, that imply or state in any way that IRENE BOZZA has given consent for the insertion of the link or that otherwise sponsors, collaborates, verifies or supervises the services of the sender.

It is strictly forbidden to use of any wordmark, graphic or mixed, or any other distinctive sign of IRENE BOZZA in the link sender’s page, except in those cases allowed by law or expressly authorized by IRENE BOZZA and provided that, in such cases, a direct link to the Portal was authorized, as long as it was made in the conditions established in this clause.

The page that includes an incoming link to the Portal must comply faithfully with the law and may not in any case include or link to content of its own or produced by any third-party that: (I) is illegal, harmful or contrary to morals or good customs (pornography, violence, racism, etc.); (II) induces or may induce in the User the misrepresentation that IRENE BOZZA subscribes, endorses, adheres or in any way supports the ideas, manifestations or expressions, lawful or illegal, of the sender; (III) is inappropriate or irrelevant to the activity of IRENE BOZZA in regard to the place, content and theme of the sender’s website.

4. Cookies

IRENE BOZZA may use cookies to provide services of the Portal. Cookies are automated information-collection procedures that store preferences determined by a user during a visit to a specific web page. This information is recorded in small files that are stored imperceptibly in the User’s computer. Every time the user accesses the website in question, these files are automatically activated so the website can be configured using the preferences indicated in previous visits. In short, cookies are physical files that contain personal information and that are stored in the User’s own computer terminal and are unambiguously associated with that specific computer terminal. Cookies cannot read cookie files created by other providers.

The User can configure the Internet browser software in such a way that prevents the creation of cookie files or that shows a warning when such activity occurs. The Portal is accessible without the need to have cookies enabled. However, not having cookies enabled might prevent the proper functioning of security mechanisms used by exclusive services or certain services that require a higher level of security. As a general rule, the purpose of the Portal’s cookie files is to facilitate user navigation.

5. Communication of illegal and inappropriate activities

In the event that the User or any other Internet user become aware that Linked Sites refer to pages whose contents or services are illegal, harmful, degrading, violent or contrary to morals, you can contact IRENE BOZZA with the following information:

Caller’s personal information: name, address, telephone number and email address.

Description of the facts that reveal the illegal or inappropriate nature of the Linked Site. In case of an alleged violation of rights such as intellectual or industrial property, also include the personal information of the rights holder whose property has been infringed, in case it is a different person than the caller. Your communication must also include the title that demonstrates the legitimacy of the rights holder and, where appropriate, proof of being legally authorized to represent and act on behalf of the rights holder if the caller is not the rights holder.

A statement that the information contained in the claim is accurate.

The receipt by IRENE BOZZA of the communication provided for the purposes of this clause does not imply, as provided in the LSSI (the Spanish Law of Information Society Services), effective knowledge of the activities and/or contents indicated by the caller.

It must also provide the title that proves the legitimacy of the rights holder and, where appropriate, the representation to act on behalf of the owner when he is a person other than the caller; Express declaration that the information contained in the claim is accurate.

The receipt by IRENE BOZZA of the communication provided for in this clause will not imply, as provided in the LSSI, effective knowledge of the activities and / or contents indicated by the caller.

6. Applicable Law

This Legal Notice shall be governed in all aspects by the laws applicable in Spain.
